Your firearm licence was refused — how to appeal
A refusal is not the end. There is a formal right of appeal, and a great many refusals are down to a fixable defect in the original application rather than anything about you. But the clock starts the day you are refused.
You have 90 days
An appeal against a refusal must be lodged within 90 days of the refusal, on the SAPS 530 Notice of Appeal. That window runs whether or not you have decided what to do, and whether or not you have managed to get hold of the reasons. Do not spend two months waiting for a letter.
Step 1 — get the reasons in writing
You cannot appeal effectively against a decision you do not understand. Ask the office that notified you for the written reasons for the refusal. If the notification you received already sets out the grounds, that is your starting point.
Refusals commonly come down to one of a handful of things:
- The motivation did not establish a need under the section applied for.
- The motivation used the wrong angle for the section — a defence reason on a sport application, or the reverse.
- Something in the background check that was not disclosed on the form.
- A document missing, expired, or inconsistent with the rest of the pack.
- Competency not valid for the firearm type at the time of application.
- Safe storage not accepted.
Step 2 — work out which kind of refusal it is
This determines whether an appeal is the right move:

| Wrong section chosen | Often better addressed by a fresh application under the correct section — but lodge the appeal too if the deadline is close, so you do not lose the right. |
| Something on your record | Appealable, but this is where you want a firearms attorney. Address it head-on with evidence of the time elapsed and your circumstances since. |
| A statutory bar — you are disqualified from holding a firearm | Take legal advice before spending money on an appeal. |
Step 3 — what a successful appeal contains
An appeal is not a re-submission of the same application with a covering note asking them to look again. It has to answer the reasons for refusal directly:
- The completed and signed SAPS 530, identifying the original application and the decision being appealed.
- Your grounds of appeal — taking each stated reason for refusal in turn and answering it specifically. Not a general plea.
- A revised motivation that fixes what was wrong with the original, stays strictly inside the section's permitted angle, and adds the detail that was missing.
- The new or corrected documents that address any document-based ground.
- The original application pack and the refusal notification, so the appeal authority can see the whole picture.
The single most common mistake
Appealing with the same motivation letter. If the motivation was the reason for the refusal, sending it back unchanged and asking for a different outcome cannot work. The revised motivation is the appeal.
Keep everything
Your copy of the original application, the acknowledgement of receipt, every status you checked and when, the refusal notification and the reasons. That paper trail is the appeal.
